Apple Sealed Own Guilt on Witness Stand?

shutterstock_56278990Of the handful of things the current ebook price-fixing legal battle between Apple and the Department of Justice hinges on, one is whether the prices of ebooks actually went up following Apple’s entrance into the market and whether that was Apple’s intention.
 
Apple says that prices overall went down. The government says that some prices on best-sellers went up and that’s all that matters.
 
Apple executive Eddie Cue might have hurt his company’s chances to come out the case a winner yesterday when, on the stand, he admitted that prices for some ebooks went up, but did not say that that was Apple’s intention, calling out the publishers, which, to his knowledge, didn’t like seeing ebooks priced at $9.99.
 
How his testimony figures in to Judge Denise Cote’s ruling could be based on whether she buys Apple’s argument for ebook pricing patterns or the DOJ’s.
